Terms of Service

1. Agreement and eligibility
These Terms govern your access to and use of CrowHub, operated by DevRaptors, operating CrowHub ("CrowHub," "we," "us," or "our"). By creating an account or using CrowHub, you agree to these Terms. You must be at least 18 years old and legally able to enter into contracts to use CrowHub.
2. CrowHub's marketplace role
CrowHub provides a local marketplace where buyers can discover and arrange purchases from independent sellers. CrowHub is a marketplace facilitator and is not the seller, owner, manufacturer, or supplier of goods listed by users, and is not a party to the underlying sale between a buyer and seller. Sellers—not CrowHub—are responsible for the goods they offer and for complying with applicable laws.
3. Accounts and seller responsibilities
You must provide accurate, current information, safeguard your account, and promptly notify us if you suspect unauthorized use. Sellers are responsible for ensuring that their listings, photos, prices, availability, condition descriptions, pickup details, and other claims are complete and accurate. Sellers must have the right to sell every listed item and must fulfil accepted transactions as agreed with buyers.
4. Reservations and payments
Depending on the listing and available features, a transaction may involve a reservation without payment, a deposit, full payment, or an arrangement between the buyer and seller to pay by cash or e-transfer. Payments made through CrowHub are processed using Stripe, including Stripe Connect for seller payouts. Stripe's terms may also apply. CrowHub does not store full payment-card numbers.
Buyers must review the listing and transaction details before committing. Sellers are responsible for taxes, reporting, licences, and other obligations arising from their sales. Cash and e-transfer arrangements occur directly between users and are not processed or guaranteed by CrowHub.
5. Pickup and QR confirmation
Buyers and sellers are responsible for coordinating and safely completing pickup. Where CrowHub provides a QR confirmation flow, the code is used to help confirm the pickup and may trigger or complete platform payment steps. Keep QR codes secure, use them only for the relevant transaction, and do not scan or share a code until the parties are ready to complete pickup. Buyers should inspect goods where practical before confirming pickup.
6. Cancellations, refunds, and disputes
Buyers and sellers should communicate promptly about cancellations, missed pickups, unavailable items, or goods that materially differ from a listing. Unless required by law, CrowHub does not guarantee a refund or reimbursement for user-to-user disputes, including no-shows, dissatisfaction, item condition, or arrangements paid outside the platform.
We may review a dispute and, where technically available and reasonably appropriate, hold, cancel, refund, reverse, or otherwise intervene in a platform-processed transaction involving suspected fraud, non-delivery, duplicate charges, or clear transaction errors. Any action is assessed case by case and is not a promise that we will resolve every dispute in a user's favour. Payment-provider rules, including Stripe's chargeback and dispute processes, may apply. Contact support promptly and provide requested information.
7. Prohibited items and conduct
You may not use CrowHub to offer, request, promote, or transact in:
- illegal goods or services, stolen goods, or counterfeit items;
- weapons, ammunition, explosives, or items intended to cause harm;
- illegal drugs, controlled substances, or drug paraphernalia;
- adult services or adult products;
- regulated goods sold without every required licence, authorization, disclosure, or safeguard;
- hazardous, recalled, unsafe, or unlawfully transported materials; or
- anything else that violates law, another person's rights, or CrowHub policies.
This list is not exhaustive. You are responsible for confirming that an item and its sale are lawful. We may remove listings or restrict transactions that we reasonably believe create legal, safety, fraud, or platform-integrity risks.
8. Messaging and acceptable use
CrowHub messaging is for legitimate marketplace and pickup coordination. Do not harass, threaten, discriminate against, deceive, spam, impersonate, exploit, or invade the privacy of others. Do not attempt to bypass security, scrape the service, introduce malicious code, manipulate reviews or transactions, or use CrowHub for fraud or unlawful activity. Messages may be reviewed when reported or when needed for safety, support, fraud prevention, or enforcement.
9. AI-assisted listing tools
CrowHub may offer tools that use artificial intelligence to help draft listing content from information or images a seller provides. AI output can be incomplete or inaccurate. It is a suggestion only: the seller must review, correct, and approve all generated content before publishing and remains fully responsible for the final listing.
10. User content and intellectual property
You retain ownership of content you submit, including listing text and photos. You grant CrowHub a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, adapt, and distribute that content only as reasonably needed to operate, improve, secure, and promote the CrowHub marketplace. You confirm that you have the rights needed to submit the content and grant this licence. CrowHub's software, branding, and other service content remain the property of CrowHub or its licensors.
11. Suspension and termination
We may remove content, restrict features, suspend transactions, or suspend or terminate an account when we reasonably believe these Terms have been violated, fraud or abuse has occurred, safety or legal risk exists, or action is needed to protect users or CrowHub. You may stop using CrowHub at any time and may request account deletion by contacting support. Obligations that by their nature should survive termination will continue.
12. Disclaimers
CrowHub is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee uninterrupted or error-free service or the identity, conduct, reliability, legality, safety, quality, authenticity, condition, availability, or delivery of any user, listing, or good. You are responsible for evaluating listings, users, and pickup arrangements and for taking reasonable safety precautions.
13. Limitation of liability
To the fullest extent permitted by law, DevRaptors, operating CrowHub, and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from CrowHub, a user, a listing, a transaction, or an in-person pickup. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless DevRaptors, operating CrowHub, and its personnel from claims, losses, liabilities, and reasonable costs arising from your content, listings, goods, transactions, conduct, violation of these Terms or applicable law, or infringement of another person's rights.
15. Changes to CrowHub or these Terms
We may modify, suspend, or discontinue features and may update these Terms as CrowHub, law, or our practices change. We will post updated Terms with a new effective date and provide additional notice where required. Continuing to use CrowHub after updated Terms take effect means you accept them, except where the law requires another form of consent.
16. Governing law
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles. The courts of Alberta will have jurisdiction over disputes, subject to any rights or remedies that applicable consumer law does not allow you to waive.
